Thieving leftist!July 16, 2018 California forced to give back $331 million stolen from home-owners Thomas Lifson What if the bluest state in the country stole a third of a billion dollars from victims of chicanery and the media refused to notice? I have been stunned at the lack of media coverage of California's foiled robbery of almost a third of a billion dollars. That's right: under Governor Jerry Brown, the Great State of California helped itself to hundreds of millions of dollars – money that was supposed to go to home-owners – and you probably didn't hear about it..... http://www.americanthinker.com/blog/2018/07/california_forced_to_give_back_331_million_stolen_from_homeowners.html

http://www.sfchronicle.com/business/article/California-ordered-to-restore -331-million-to-13067597.php Of the $410 million, at least $331 million was designated by then-state Attorney General Kamala Harris for a fund devoted to programs assisting homeowners who were harmed by the wave of foreclosures. The programs included housing counselors, foreclosure assistance hotlines, legal aid, consumer education and efforts to investigate and combat financial fraud. After the fund was established, however, the state’s Finance Department appropriated the money, with legislative approval, to pay off deficits to the state agencies in charge of state housing bonds and other consumer-related measures. State lawyers argued that the payments were consistent with the mortgage settlement and were not subject to judicial review, but the court disagreed.
Not exactly a secret. Seems govt agencies disagreed about what to spend it on. What a surprise. Good thing Cal has a surplus to fix the situation with. This was reported on by the NYT in 2015. And several other outlets since. Good job the American Tinker was on the ball or you would never have known about it eh?😉 IP: Logged |

Sorry but you don't know what you're talking about. This decision by the 3rd District Court of Appeals was handed down on July 10, 2018.Filed 7/10/18 CERTIFIED FOR PUBLICATION IN THE COURT OF APPEAL OF THE STATE OF CALIFORNIA THIRD APPELLATE DISTRICT (Sacramento) ---- NATIONAL ASIAN AMERICAN COALITION et al., Plaintiffs and Appellants, v. EDMUND G. BROWN, JR., as Governor, etc., et al., Defendants and Appellants. C079835 (Super. Ct. No. 34201480001784CUWMGDS) APPEAL from a judgment of the Superior Court of Sacramento County, Timothy M. Frawley, Judge. Reversed in part and remanded with directions. REMCHO, JOHANSEN & PERCEL, Robin B. Johansen and Margaret R. Prinzing for Edmund G. Brown Jr., as Governor, and Michael Cohen, Director of Finance; Office of the State Controller, Richard J. Chivaro, Ronald V. Placet and David I. Brownfield for Betty T. Yee, Controller, Defendants and Appellants. JENNER & BLOCK, Rick Richmond, L. David Russell, Neil M. Barofsky (admitted pro hac vice), Jessica Ring Amunson (admitted pro hac vice) and Robert L. Gnaizda for Plaintiffs and Appellants. DISPOSITION The portion of the judgment declining to issue the requested writ of mandate is reversed and the matter is remanded to the trial court with directions to issue a writ of mandate directing defendants, Edmund G. Brown Jr., Governor, Michael Cohen, Finance Director, and Betty Yee, Controller, to retransfer from the General Fund to the National Mortgage Settlement Deposit Fund the sum of $331,044,084. The parties shall bear their own costs on appeal. (Cal. Rules of Court, rule 8.278(a)(5).) Leftist thieves stole $331 Million from the Mortgage Settlement Deposit Fund. Just doing what leftists always do. Grab other people's money.
Especially egregious considering the money was to go to citizens who had their homes foreclosed under fraudulent circumstances by lenders. IP: Logged |

A court ruled late Friday that California is obligated to return $331 million that it took from a fund designated to help troubled borrowers but instead used to plug holes in the state’s budget...H. D. Palmer, a spokesman for the California Department of Finance, said that the state was reviewing the ruling and had not yet decided on its next step... http://www.nytimes.com/2015/06/16/business/california-has-to-repay-331-million-to-homeowners-fund-court-rules.html IP: Logged |

The original decision was a lower court ruling...which was appealed...with the Appeals Court overruling that decision. Fact remains that Brown was a defendant in the court action. That Brown and others stole $331 Million from the funds which were established to help citizens who were foreclosed by banks and other lenders using fraudulent documents and tactics. Which is exactly what I said...from the beginning of this thread. IP: Logged | |
