On Monday, the January 6 Bullsh*t Committee will give its “criminal referrals” on President Trump to the Justice Dept. Since when can legislators make criminal referrals? Everyone on that kangaroo court is a joke. But it gets worse because 41 Dems have introduced a bill to block President Trump from running for any public office. Every one of them should be thrown out for violating their oaths of office. That is a Bill of Attainder and is explicitly barred by the Constitution. Furthermore, they cite Section 3 of the 14th Amendment, which states that insurrection bars public office, but they conveniently forget Section 4, which states that it is referring to the Civil War and slavery (a little convoluted in the way it is written, but the framers’ intent is clear). These bozos are an embarrassment.IP: Logged |

Section 4 has always been thought by legal scholars to make Section 3 applicable to the Civil War, so it wasn’t my catch. The Founding Fathers thought Bills of Attainder so abhorrent that the Constitution bars them at both the federal and state levels. The legislature cannot set a punishment specifically to an individual or group of individuals for past actions for which those individuals have not been tried.IP: Logged |

what utter ******** . The democrats are trying to protect democracy. some of you have even come out with, "This isn't a democracy" which makes it sound an awful lot like you'd be fine with rumpy doing whatever the hell he wants to.
rumpy wanted to terminate the constitution, so that he could be reinstated illegally, as president. Then we'd never have another election, according to some of his supporters. IP: Logged |

Dems don’t give a sh*t about the Constitution. Lockdowns were unconstitutional. Mandatory vaccines also were. A federal election law was unconstitutional on its very face. So is the idea of making DC a state. Dems want to trash the 2nd Amendment and already do so with the 1st Amendment. IP: Logged |

I’ll be adding more to this thread about Bills of Attainder. In Nixon v. Administrator of General Services, the Supreme Court set a simple two-pronged test for determining what a Bill of Attainder is. 1. It applies with specificity. 2. It imposes punishment without a trial. This proposed bill by the 41 deranged Dems mentions President Trump specifically and obviously punishes him.IP: Logged |
