Lawyer Robert Barnes re the law on gag orders quote: A gag order would be in violation of the First Amendment. Generally speaking, gag orders in a criminal context are unconstitutional, whether applied to the lawyer or applied to the defendant. It has to be very narrowly tailored and they have to show a compelling public interest. So, for example, on the eve of a jury trial [they can] restrain what someone can say that won’t come into evidence at the trial. That’s the very limited scope in which higher courts have allowed gag orders. Otherwise, they’re just flat out unconstitutional.So if this judge attempts to do that it will show again this judge’s incapacity to be impartial, [it will] show the political prejudice and prosecutorial tendencies of this prosecution if they request such a gag order. It will be a First Amendment violation. I’m sure the president will take it up on appeal immediately all the way to the Supreme Court of the United States and it’s the kind of case the Supreme Court is likely to take because if by merely charging someone you can prevent your political opponent from campaigning, then that would be a serious problem…The judge can try a gag order, it may be temporarily enforceable, but it’s not constitutionally enforceable and I anticipate it’ll be set aside if the judge does it.

If this leftist judge attempts to impose a gag order in this star chamber trial of Donald Trump, I hope his attorneys will immediately file a motion to vacate this judge's order and file for a change of venue. Every defendant is entitled to a fair and impartial trial venue. IP: Logged |

Yes, like Upstate NY or Staten Island. Barnes also mentioned he's not impressed with President Trump's lawyers. He says Alan Dershowitz has a track record of success and would be the right lawyer to lead in this case. IP: Logged |

That doesn’t even include all of the tens of millions of dollars of free press this will get President Trump. With all of the pretrial motions, this could stretch out for quite a while. The democrats truly do fear Donald Trump, down to the marrow of their bones. So much so that they have abandoned all principles and ideals (i.e., democracy) in their ruthless effort to destroy one man. The democrat party is destroying itself. I watched as Alan Dershowitz explained why he isn't part of Trump's defense team. He said his defense is a one of a kind action, that he doesn't make a habit of defending the same defendant more than once. Also, that he's more interested in upholding 'the rule of law' than defending individuals. Dershowitz is adamant that Trump can't get a fair trial in Manhattan and the venue should be changed. Stormy already said there was no affair. She lied to get money. She is the only one who committed a crime. That’s extortion/blackmail. Hush money isn’t illegal. Bill Clinton paid $850,000.
